International Investment Dispute Settlement: From Ad Hoc Arbitration to a Permanent Court
2014 saw the eruption of a fierce political and public debate on the Transatlantic Trade and Investment Partnership (TTIP). Investment disputes are sometimes resolved through international arbitration. Investors can generally also turn to national courts, though national proceedings do not always offer sufficient safeguards to prevent discrimination against foreign investors. In the AIV’s view, some form of international investment dispute settlement mechanism is therefore required.
